It is another step in the government's  campaign, which began with the publication of Lord Young's report in  October 2010, to free health and safety from the unhealthy and unhelpful  reputation that has developed in recent years.&lt;br /&gt;&lt;br /&gt;Chris Grayling - Minister for Health and Safety – is quoted as saying:&lt;br /&gt;&lt;i&gt;&lt;b&gt;"The Royal Wedding will be a great national occasion, and I  want to reassure everyone that they can have street parties with friends  and family and bring out the bunting to celebrate in time-honoured  British tradition. The sad fact is that it still accounts for a large number of fatalities and serious injuries in the workplace.&lt;br /&gt;&lt;br /&gt;When we last wrote about this topic, the regulations had just been changed to consolidate previous legislation and during the intervening time there have been further extensions of the regulations to cover situations such as recreational activities like caving or rock climbing.&lt;br /&gt;&lt;br /&gt;Whilst much work at height is associated with the Construction industry, it is not exclusively so. Health and Safety issues also come to the fore when something  tragic happens and we have to face the courts and the blaze of adverse  publicity.  However, in between there is the ongoing work of maintenance  and over time it is easy to become distracted from the importance of   this critical activity.&lt;br /&gt;&lt;br /&gt;Back in April when we published our &lt;a href="http://www.edp-uk.net/newsletter-articles/maintenance.htm" target="_blank" title="Maintenance Work"&gt;previous article&lt;/a&gt;,  it coincided with the BP Oil tragedy in the Gulf of Mexico.  Today our  news channels are dominated by the massive spillage of toxic waste in  Hungary and the plight of the trapped miners in Chile.  We don't yet  know the full circumstances behind these situations but there is a good  chance that failures in the maintenance regime will be implicated to  some degree.&lt;br /&gt;&lt;br /&gt;Maintenance is to be the focus of &lt;b&gt;European Safety Week&lt;/b&gt; which is scheduled to run between &lt;b&gt;25th and 29th October&lt;/b&gt;  this year.  Everyone who has an interest in or responsibility for  health and safety is able to take part in this initiative.  To quote the  European Agency for Safety and Health at Work:&lt;br /&gt;&lt;br /&gt;&lt;i&gt;&lt;b&gt;"The Week is intended for organisations, enterprises and  companies of various sizes and from various sectors. The Week is mainly  intended for participants from the SME sector. Everyone involved in  matters relating to health and safety at work are invited to take part,  in particular health and safety institutes and organisations, trade  unions, employer organisations, companies, managers, employees and  representatives of organisations in the area of working conditions."&lt;/b&gt;&lt;/i&gt;&lt;br /&gt;&lt;br /&gt;Participating organisations are able to submit their solutions for  the week's theme, i.e. Maintenance.  The submissions will be judged to  identify the most practical and innovative approaches to managing risk,  with the best receiving awards for good practice. On an average day, there are around 70 serious injuries on our roads and around 7 deaths, which amounts to astonishing carnage.&lt;br /&gt;&lt;br /&gt;Many drivers routinely take unnecessary risks in the apparent belief that serious accidents "simply don't happen to them". Of course serious accidents do happen all the time and to people from every walk of life.&lt;br /&gt;&lt;br /&gt;Sometimes the blame lies wholly or partly with the victims of such accidents, but the injustice is that victims are often completely innocent people who happen to be in the wrong place at the wrong time.&lt;br /&gt;&lt;br /&gt;A significant factor in all of this, which has been highlighted by a recent survey, is the problem of people driving when they are too tired to do so safely. Identify any hazard &lt;br /&gt;2. Identify the risk of harm to safety or health of individuals&lt;br /&gt;3. Identify who might be affected&lt;br /&gt;4. Put in place appropriate measures to manage the risk&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Hazard&lt;/b&gt;&lt;br /&gt;In the case of the hazard, we already know it is particles of volcanic ash in the atmosphere.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Risks&lt;/b&gt;&lt;br /&gt;At one level there is a risk associated with air travel, though this is probably being adequately managed by NATS, the Air Traffic Control Organisation.&lt;br /&gt;&lt;br /&gt;At a more prosaic level, we all need to consider the potential health implications of inhaling the dust.  The Health Protection Agency (HPA) currently advises that this is not a significant risk – at least not for normally healthy individuals.&lt;br /&gt;&lt;br /&gt;The reasons for this assessment are that the ash is currently suspended too high in the atmosphere to be inhaled and, although it could be brought to earth by rainfall, this also poses low risk because the particles are not easily inhaled under wet conditions.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Who Affected&lt;/b&gt;&lt;br /&gt;There is a possible health risk, however, should any dust that has fallen to the ground be subsequently disturbed by windy conditions.  The people at risk under these conditions include anyone with an existing respiratory condition such as asthma, chronic bronchitis or emphysema.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Controls&lt;/b&gt;&lt;br /&gt;For such people, the advice is to ensure they carry their inhalers or other medication with them, particularly when outdoors. The ECHA then makes the information available to the public.&lt;br /&gt;&lt;br /&gt;Compiling the central register of information on chemical substances is a mammoth task that is scheduled to take a number of years. The result is that the burden of training is less onerous for the majority of workplaces. This responsibility is never greater than when considering fire safety.&lt;br /&gt;&lt;br /&gt;Fire safety begins with a Fire Risk Assessment. If you don't have one, you need one as quickly as possible. If you have one, it needs to be kept up to date and checked that all findings have been actioned. First Case</title><content type='html'>The Corporate Manslaughter and Corporate Homicide Act has been in force since April 2008. In &lt;a href="http://www.edp-uk.com/newsletters/mobilephones2.htm" title="Increased penalties for drivers using mobile phones" target="_blank"&gt;2007&lt;/a&gt; the penalties were increased so that you  now risk a fixed fine of 60GBP and 3 penalty points on your licence.&lt;br /&gt;&lt;br /&gt;The law explicitly applies to hand-held phones and most drivers feel safe when using hands-free equipment. type='text'>Carbon Reduction Commitment</title><content type='html'>Until recently, most of the environmental work undertaken by businesses in the UK has been largely voluntary.&lt;br /&gt;&lt;br /&gt;However, the law is fast catching up and new mandatory targets are shortly to be introduced.&lt;br /&gt;&lt;br /&gt;One such government initiative goes under the name of the "Carbon Reduction Commitment" (CRC) which, as its name implies, requires organisations that are heavy energy users to make ongoing commitments to reduce their contribution to greenhouse gas emissions.&lt;br /&gt;&lt;br I'm thinking about the heavy goods vehicle drivers. Most of us at one time or another have wished they would get out of our way, but the fact is that much of modern life that we take for granted would not be possible without them.&lt;br /&gt;&lt;br /&gt;Not only must they put up with crowded roads all day and every day, they also face many risks to their health and safety. In fact the rate of accidents in the industry ranks as one of the highest.&lt;br /&gt;&lt;br /&gt;That doesn't only reflect on haulage firms as employers. Most of us who are in business also carry some responsibility for their safety. At that time we were anticipating introduction of the initial legislation.&lt;br /&gt;&lt;br /&gt;Since then the evidence has been mounting about just how dangerous the practice is. In addition, it has become clear that people who are driving as part of their work are more likely than most to be involved in accidents where mobile phones are implicated.&lt;br /&gt;&lt;br /&gt;The obvious conclusion is that if you are in business or if you need to drive for work, then the revised regulations are very important indeed.&lt;br /&gt;&lt;br /&gt;As with any legislation, the precise meaning will only be known once it is "tested" in a court of law. On the other hand it may not trouble you at all.&lt;/p&gt;&lt;p&gt;Claustrophobia in confined spaces, however, is not the main concern of health and safety. It’s more to do with the hidden risks that lurk in places were there is a lack of adequate ventilation or where access and egress are difficult – things like reduced oxygen levels, build up of noxious gases, sudden and rapid flooding, build up of heat, presence of explosive gases and other things.&lt;/p&gt;&lt;p&gt;Part of the problem is that circumstances can change in unexpected ways between places that are superficially similar or in the same place over a period of time. It’s this ‘uncertainty’ aspect that is the subject of our latest newsletter.&lt;/p&gt;&lt;p&gt;Perhaps you think that confined space working doesn’t affect you but then you may be wrong. You see a confined space doesn’t have to be physically small. An enclosed place of any size – even for example as big as a grain silo – may be a confined space if certain risks are present.&lt;/p&gt;&lt;p&gt;As demonstrated by this month’s example under Case Law, it’s easy to become complacent but that can prove very expensive in the long run.
