We now know what the HSE intends to do in regard to charging for its services.

In addition to simply cutting their own costs, the stated aims of the HSE are:

To make those organisations pay who breach health and safety law and to provide a more level playing field so that those who flout the law have less of a competitive edge on more responsible organisations.

The net result will be that those who are found to be in breach of the law will have additional costs to pay over and above any fines that might be imposed by the courts -

Cost Hike for Health + Safety

In March 2011, the Department for Work and Pensions published their latest plans on the reform of Health and Safety in Britain.

In their report entitled "Good Health and Safety, Good for Everyone" they stated their intention to introduce provisions that would recover the costs for breaches of health and safety law. These provisions are now expected to come into force as early as April next year.

The actual recovery of costs is not up for debate. However, the systems for implementing cost recovery are currently the subject of consultation and you can have your say.

Health and Safety for Royal Wedding

It seems incredible that when we are looking forward to an event that is of world-wide interest – we're referring to the Royal Wedding of course – that a government department finds it necessary to warn officials not to use Health and Safety as an excuse for suppressing celebrations.

Not everybody, of course, is in favour of royalty but even the most ardent anti-royalist would prefer to make their case on the basis of facts, and reasoned argument rather than seek to disrupt the event by calling on regulations that are designed to save lives in the workplace rather than constrain national celebrations.
Nevertheless, the Health and Safety Executive felt it necessary to issue a press release advising how to respond to officials who attempt to cite Health and Safety as a reason for constraining celebrations of the royal wedding.

This is another attempt by the HSE and the government to re-focus attention on the true reason for, and the genuine benefits from Health and Safety legislation. It is another step in the government's campaign, which began with the publication of Lord Young's report in October 2010, to free health and safety from the unhealthy and unhelpful reputation that has developed in recent years.

Chris Grayling - Minister for Health and Safety – is quoted as saying:
"The Royal Wedding will be a great national occasion, and I want to reassure everyone that they can have street parties with friends and family and bring out the bunting to celebrate in time-honoured British tradition. There is no reason whatsoever for anyone to ban these celebrations on the grounds of health and safety."

Ongoing Review of Health and Safety

Before last year's general election, David Cameron had much to say about Health and Safety in UK workplaces. This was largely in response to stories appearing in the media regarding some of the more bizarre ways in which organisations have chosen to implement Health and Safety requirements.

Unfortunately some people have used Health and Safety as a convenient excuse for cancelling events or banning activities that, pose little or no significant risks.
In other cases, sections of the media have picked up and perpetuated myths simply because they make good reading.
There are also cases where people have acted in good faith but their decisions have been based on inadequate understanding of Health and Safety regulations or on flawed information from advisers who lacked appropriate qualifications, experience and professionalism.
And then there are cases where Health and Safety legislation could be expressed in terms that are easier for everyone to understand and act upon.

For all of these reasons, the government has embarked on a major review of the whole area of Health and Safety, starting last year with the publication of Lord Young's report and continuing with the next stage of the review process that was announced earlier this month.

Working Safely at Height

It is almost six years since we published an article about working at height (see previous article). The sad fact is that it still accounts for a large number of fatalities and serious injuries in the workplace.

When we last wrote about this topic, the regulations had just been changed to consolidate previous legislation and during the intervening time there have been further extensions of the regulations to cover situations such as recreational activities like caving or rock climbing.

Whilst much work at height is associated with the Construction industry, it is not exclusively so. A few obvious examples of other industries are Telecommunications, Power, Engineering and Freight, to name but a few.

Using Lifting Equipment Safely

One means of reducing the risks associated with manual handling operations is to introduce lifting equipment. However, lifting equipment introduces its own risks that must be properly managed.

There are very specific legal requirements that apply to lifting equipment that is supplied or used in the workplace and these are embodied in the Lifting Operations and Lifting Equipment Regulations (LOLER) that were introduced in the UK in 1998.

What is certain is that the culture existing within an organisation plays a major role in determining the general level of health and safety. It is useful, therefore, to be able to assess and measure the level of health and safety culture and identify means by which it can be boosted.

Impact of the Corporate Manslaughter Act

The first case under the Corporate Manslaughter and Corporate Homicide Act 2007 has now come to a conclusion, although the company involved may still decide to lodge an appeal.

The company – Cotswold Geotechnical Holdings - is relatively small with just eight employees and therefore many people do not consider this to be a realistic test case for the new Act.

Welfare Facilities for Construction Workers

Proposed Changes to Accident Reporting

If we are striving to improve anything, accurate statistical recording is an essential element so that we can identify what measures are effective and to what extent.

Changes to RIDDOR (Reporting of Injuries Diseases and Dangerous Occurrences Regulations) was among a number of recommendations made by Lord Young in his review of UK Health and Safety.

Lord Young concluded that the present arrangements are too cumbersome and bureaucratic. As a result, the accuracy of any statistical information was suspect due to significant under reporting.

The government has now published its proposals to change the operation of RIDDOR and the HSE has opened a consultation on the proposals which is scheduled to run until May 2011

Register of Health and Safety Consultants

Containing Risk During the Fire Service Dispute

London Fire Brigade and the Fire Brigades Union are currently in dispute over proposals to change patterns of shift working.

European Safety Week

Earlier this year we published an article on the importance to Workplace Health and Safety of good, well-managed maintenance.

We take account of Health and Safety when designing new plant and premises. Health and Safety issues also come to the fore when something tragic happens and we have to face the courts and the blaze of adverse publicity. However, in between there is the ongoing work of maintenance and over time it is easy to become distracted from the importance of this critical activity.

Back in April when we published our previous article, it coincided with the BP Oil tragedy in the Gulf of Mexico. Today our news channels are dominated by the massive spillage of toxic waste in Hungary and the plight of the trapped miners in Chile. We don't yet know the full circumstances behind these situations but there is a good chance that failures in the maintenance regime will be implicated to some degree.

Maintenance is to be the focus of European Safety Week which is scheduled to run between 25th and 29th October this year. Everyone who has an interest in or responsibility for health and safety is able to take part in this initiative. To quote the European Agency for Safety and Health at Work:

"The Week is intended for organisations, enterprises and companies of various sizes and from various sectors. The Week is mainly intended for participants from the SME sector. Everyone involved in matters relating to health and safety at work are invited to take part, in particular health and safety institutes and organisations, trade unions, employer organisations, companies, managers, employees and representatives of organisations in the area of working conditions."

Participating organisations are able to submit their solutions for the week's theme, i.e. Maintenance. The submissions will be judged to identify the most practical and innovative approaches to managing risk, with the best receiving awards for good practice. Any organisation that operates in Europe can benefit from the EU wide recognition of their efforts.

Many organisations in the UK will be arranging events to coincide with the European Safety Week, so it is worth searching online for any that are planned in your area.

Workplace Fatalities

Workplace fatalities' is a sobering topic, but as long as a single person loses their life or is seriously injured due to an avoidable accident, it is something we all need to dwell on from time to time.

The Health and Safety Executive have just released their latest statistics on workplace deaths and whilst the numbers make grim reading, the positive news is that there appears to be continuing improvement of safety in UK workplaces.

Too Tired to Drive

As the UK roads become increasingly busy, so the risks of serious accidents and deaths also increase. On an average day, there are around 70 serious injuries on our roads and around 7 deaths, which amounts to astonishing carnage.

Many drivers routinely take unnecessary risks in the apparent belief that serious accidents "simply don't happen to them". Of course serious accidents do happen all the time and to people from every walk of life.

Sometimes the blame lies wholly or partly with the victims of such accidents, but the injustice is that victims are often completely innocent people who happen to be in the wrong place at the wrong time.

A significant factor in all of this, which has been highlighted by a recent survey, is the problem of people driving when they are too tired to do so safely. What is even more worrying is that the prevalence of such behaviour is actually getting worse.

Work of the Maintenance Department

Health Implications of the Volcanic Ash Cloud

Employers may be wondering if the cloud of volcanic ash, which is currently causing so much havoc for air travel throughout the UK and much of Europe, has any health implications for their employees.

Applying the basic approach to risk assessment, we need to:

1. Identify any hazard
2. Identify the risk of harm to safety or health of individuals
3. Identify who might be affected
4. Put in place appropriate measures to manage the risk

Hazard
In the case of the hazard, we already know it is particles of volcanic ash in the atmosphere.

Risks
At one level there is a risk associated with air travel, though this is probably being adequately managed by NATS, the Air Traffic Control Organisation.

At a more prosaic level, we all need to consider the potential health implications of inhaling the dust. The Health Protection Agency (HPA) currently advises that this is not a significant risk – at least not for normally healthy individuals.

The reasons for this assessment are that the ash is currently suspended too high in the atmosphere to be inhaled and, although it could be brought to earth by rainfall, this also poses low risk because the particles are not easily inhaled under wet conditions.

Who Affected
There is a possible health risk, however, should any dust that has fallen to the ground be subsequently disturbed by windy conditions. The people at risk under these conditions include anyone with an existing respiratory condition such as asthma, chronic bronchitis or emphysema.

Controls
For such people, the advice is to ensure they carry their inhalers or other medication with them, particularly when outdoors. If they suspect they are being affected by the dust – e.g. runny nose, sore throat or strong smells of sulphur or rotten eggs – then they should return indoors.

Employers who believe any of their workers may be affected would be wise to issue this advice and ensure there are no obstructions that would prevent workers from complying.

The good news is that any adverse effects are likely to be short term unless, of course, the vagaries nature decide differently!!

CRC Energy Efficiency Scheme

This is part of the Government's initiative to massively reduce the UK's energy consumption and corresponding carbon dioxide emissions by 2050

First Corporate Manslaughter Court Case

The Corporate Manslaughter and Corporate Homicide Act is in the news again.

This time it is the culmination of years of discussion and debate – first about the Act itself, what it should cover and to whom it should apply – then about the penalties that should be imposed.

The Act was brought in after public outcries about such major tragedies as the capsizing of the Herald of Free Enterprise ferry outside Zeebrugge the Bradford City fire and the rail disasters at Southall and Paddington. The law was unable to convict any person or organisation in regard to these accidents.

The first case under the new Act has now been brought to court and judgement made.

This first case is not on the same scale as the major disasters of past years, but it resulted in the death of a young man, which is every bit as devastating for his family, his colleagues and others who knew him.

Do Not Forget to Report an Accident

When you've messed up or something bad has happened, you may be tempted to keep quiet about it and hope to avoid the consequences.

An accident happened at a Midlands based company in which a man was injured in a fall when a mezzanine floor collapsed underneath him. The company didn't report the accident to the Health and Safety Executive (HSE) until 8 months later and then it only came to light when an inspector was investigating another issue.

Under health and safety law, there are some things that have to be reported to the HSE. Failing to do so is an offence and no excuses are accepted.

You have probably heard mention of the European REACH Regulation.

The purpose of "Registration, Evaluation, Authorisation and Restriction of Chemicals" (REACH) is to enable people to make informed decisions regarding the use of chemical substances in the workplace.

A central plank of the Regulation is to provide ready access to data on potentially hazardous substances to which workers may be exposed.

To this end, EU companies that manufacture or import substances may be required to register information with the European Chemicals Agency (ECHA), which is the body set up to administer the implementation of REACH. The ECHA then makes the information available to the public.

Compiling the central register of information on chemical substances is a mammoth task that is scheduled to take a number of years. However, a start has been made and ECHA has recently published the first version of its database.

Taking Precautions in Bad Weather

Winter is upon us again and in the UK it has arrived with a vengeance. There is even serious talk about an "official" white Christmas for the first time in years – much to the consternation of the bookmakers.

Drivers' Use of Mobile Phones on the Increase

We return to the topic of using hand-held mobile phones whilst driving.

The latest news is that it is on the increase, in spite of the fact that it can be clearly demonstrated to be an extremely dangerous practice.

As well as being an endorsable offence, anyone who is caught by the police faces a hefty fine.

If you are involved in an accident whilst using a phone, the police have access to incontrovertible evidence with which to prosecute you, regardless of who may appear to be responsible for the accident according to other evidence.

Mobile phone offences whilst driving are primarily dealt with under road traffic legislation, but employers need to be aware that under health and safety legislation they carry a degree of responsibility for the actions of their employees whilst driving.

European Eco Design Regulation

The climate change summit that is now underway in Copenhagen has raised the media profile for everything to do with global warming, saving the environment and energy conservation.

Expectations vary widely as to what will be achieved by the summit, which is looking at many major issues that may prove difficult to resolve, both politically and financially.

Meanwhile, there are many other initiatives that are going on in parallel. Their goals may be much less ambitious but it is often the smaller actions which, when adopted by large numbers of people, deliver the practical benefits.

One such initiative is an Energy Regulation that is part of the European Eco Design Directive and which comes into force early in January 2010.

New Guidance for First Aid

The dust has now had time to settle after new guidance on First Aid in the Workplace was introduced by the Health and Safety Executive in October 2009.

After years of talking about it, the HSE announced changes to its guidance in April 2009. The result is that the burden of training is less onerous for the majority of workplaces. Even organisations that are deemed to be high risk, only need to release their staff for a three day training course instead of four, as previously.

For most businesses that are assessed as being low risk, they only need to send their people on a one day Emergency First Aid at Work course.

What does the new guidance mean for your organisation? Don't be taken in by some who would tell you that all your First Aiders need to be retrained immediately. Read on for a fuller explanation of the new guidance.

Effective Risk Assessments

New Hazardous Waste Strategy for England

Registration for UK Battery Manufacturers and Importers

The UK Government is at pains to reduce the amount of waste we send to landfill sites and, more particularly, to recycle rubbish that contains materials with the potential to pollute the environment and which may also be of significant value in their own right.

Register of Accredited Safety Professionals

Business wouldn't be possible without a degree of trust between parties, but sometimes that trust is betrayed, resulting in goods or services that are not fit for purpose. This caution applies equally in the area of Health and Safety.

Almost anyone can decide to call themselves a consultant and set themselves up in business, regardless of whether or not they have any qualifications or experience.

Wrong advice, although accepted in good faith, can be a recipe for disaster and the consequences can be far reaching.

New Guidance for Asbestos Surveys

If you are considering any refurbishment work or you are planning to demolish premises in the near future then you need to be aware of some new guidance that the HSE has in the pipe-line for publication.

Swine Flu Update

The number of confirmed cases of swine flu in the UK has now risen to more than 2,700. Although most symptoms have been relatively mild, over 30 people were admitted to hospital with the infection.

Freight Transport - Unsafe Loads

A recent survey by the HSE and VOSA highlighted the hazards faced by all road users from freight vehicles that are incorrectly loaded.

Although the survey only involved a few vehicles, the HSE considered the results to be alarming and are planning to launch a campaign later this year that will be aimed at those responsible for loading and unloading vehicles.

As such they represent something or a wakeup call to anyone with responsibilities for freight transport - however large or small.

Corporate Manslaughter Act - First Case

The Corporate Manslaughter and Corporate Homicide Act has been in force since April 2008. In April 2009, almost a year later, the first company has been charged under the Act.

The case concerns a Junior Geologist who lost his life whilst working on a construction site at Brimscombe Lane, near Stroud in Gloucestershire.

If found guilty under the Act, the company faces an unlimited fine and a Director of the firm, who is also charged with manslaughter, could face life imprisonment.

However, we have yet to see if the charge of Corporate Manslaughter will be successful in this case.

The case is scheduled to be heard at Stroud Magistrates court on Wednesday 17th June, when undoubtedly it will attract yet more publicity.

Swine Flu

We are at the beginning of Spring and the media is full of stories about Influenza. Somehow it just doesn't seem right but it is, nonetheless, a serious issue - potentially very serious.

For reasons that are not yet clear, Mexico appears to be suffering more than any other country from this Swine Flu epidemic. The death toll has already exceeded 150 and there are many more confirmed sufferers.

Two cases have been confirmed in the UK and the UN has stated that the epidemic cannot be contained, so we can expect to see more.

Hands-Free Phone User Prosecuted

Since 2003 it has been illegal to use a hand-held phone whilst driving. In 2007 the penalties were increased so that you now risk a fixed fine of 60GBP and 3 penalty points on your licence.

The law explicitly applies to hand-held phones and most drivers feel safe when using hands-free equipment. However, in our last newsletter on this topic, we pointed out that even when using hands-free, a driver could be convicted of careless or even dangerous driving.

In a recent, quite high-profile case, a driver has been prosecuted after a fatal accident that involved use of hands-free kit.

Slips Trips and Falls Campaign

It seems strange how we respond differently to news stories and our own experiences. For example, we are horrified when an aircraft crashes, possibly killing all on board, whilst we don't think twice about driving on UK roads where the death and accident toll is many times greater.

Similarly, many people who see floor conditions that could cause slip or trips will step over or walk around them with little thought that they could cause serious injury or even death.

Health and Safety (Offences) Act

In June of last year, we mentioned in our newsletter that there was a private member’s bill progressing through parliament entitled the Health and Safety (Offences) Bill 2008.

Although private members' bills are notorious for failing to make it onto the statute book, this one has succeeded where others have failed. It passed through parliament in October 2008 and came into force on the 16th January 2009. Consequently, any offences committed after the 16th January may be subject to much stiffer penalties.

Update on Managing Asbestos

It's always worth monitoring what campaigns are being pursued by the Health and Safety Executive. At present, there are two initiatives which together mean that any organisation could receive a visit from an inspector at any time.

The first is an asbestos campaign that is aimed at stemming the increasing numbers of people who are dying from asbestos related illnesses.

The second is a policy of local regional blitzes of as many organisations as possible in selected geographical areas.

The combined effect of these initiatives is that no organisations can consider themselves safe from prosecution if they are ignoring their duty to manage asbestos in their premises.

Construction – CDM Coordinator

With the Health and safety Executive targeting the Construction industry with spot checks, we thought we should again draw your attention to the dangers of poor standards of safety when building new or refurbishing existing buildings.

This month we are highlighting the role of the CDM Coordinator.

We have been living with the latest Construction (Design and Management) Regulations for well over a year.

These Regulations will affect most organisations sooner or later when they decide to extend their premises, move to a new location, demolish old facilities or embark on any other construction project.

At such times you need access to the best available advice in regard to health and safety aspects, which is where the CDM Coordinator role becomes important.

Under the new Regulations, you cannot afford to "sort out what you want to do first" and then call for advice when the building contractor moves on to your site. You need to take advice from the earliest design stages to ensure you comply with your legal duties.

It is worth knowing, therefore, something about the role of CDM Coordinators before you need to call on their services. This month's article is written from our own first-hand experience since the introduction of the latest Regulations.

Carbon Reduction Commitment

Until recently, most of the environmental work undertaken by businesses in the UK has been largely voluntary.

However, the law is fast catching up and new mandatory targets are shortly to be introduced.

One such government initiative goes under the name of the "Carbon Reduction Commitment" (CRC) which, as its name implies, requires organisations that are heavy energy users to make ongoing commitments to reduce their contribution to greenhouse gas emissions.

Although the CRC is scheduled to come into force in two years time, it will use 2008 as a benchmark, so it's never too soon to start thinking about it.

Nanotechnology – Benefits and Risks

The wonders of modern technology have brought many benefits to humanity, but can also bring new hazards for people and the environment.

This is particularly true when technologies are still in their infancy, when risks are increased due to greater uncertainty. Genetically Modified (GM) crops is an example that has received much media coverage as the potential benefits and hazards are vigorously debated.

Another technology, that is equally contentious, though it has received less media coverage, is Nanotechnology. It is difficult to comprehend the potential it has to impact and revolutionise almost every aspect of life. It is equally difficult to envisage the possible risks it might bring.

Nevertheless, the application of this technology is growing rapidly and everyone will be impacted by it. For this reason we have to consider seriously the health and safety implications for organisations and businesses.

Corporate Manslaughter Revisited

You can never be certain about the twists and turns of judicial systems, particularly as they operate in other national jurisdictions.

Here in the UK, the new Corporate Manslaughter and Corporate Homicide Act 2007 is about to come into force. For convenience, I have referred to it elsewhere in this newsletter simply as the "Corporate Manslaughter Act"

Since it is untested in the courts, there remains a degree of uncertainty in regard to its application, though we are able to make a fair assessment of its likely impact on UK businesses and other organisations.

From directors down, if you have any responsibility for health and safety in your organisation, then it behoves you to learn as much as you can about this new legislation and ensure you are well prepared for it.

Training and Competence

This month we are highlighting an important aspect of health and safety but one that is often overlooked or is given lip service only.

Under Health and Safety legislation, employers have a duty to provide adequate Training for their employees.

Road Haulage

British roads just seem to get more and more crowded and you would be forgiven for wondering how long it will be before our busiest roads simply grind to a halt.

If, like me, you are a car driver, then spare a thought for those who literally spend nearly all of their working lives on the road. I'm thinking about the heavy goods vehicle drivers. Most of us at one time or another have wished they would get out of our way, but the fact is that much of modern life that we take for granted would not be possible without them.

Not only must they put up with crowded roads all day and every day, they also face many risks to their health and safety. In fact the rate of accidents in the industry ranks as one of the highest.

That doesn't only reflect on haulage firms as employers. Most of us who are in business also carry some responsibility for their safety. So alongside benefiting from their work, let us also ensure we are doing all we should to protect their health and safety.

Smoking in Public Places

The topical issue for this month’s newsletter is the Smoking Ban that is currently being rolled out throughout the UK. If you haven’t made your arrangements already for this legislation you are running out of time fast.

However, I have some other fantastic news that I just had to share with you, which is that one of our biggest clients has recently been awarded the British Safety Council's 5-Star Award for health and safety.

Mobile Phones and Driving - Update

It's more than three years since we last wrote about the ban on using mobile phones whilst driving. At that time we were anticipating introduction of the initial legislation.

Since then the evidence has been mounting about just how dangerous the practice is. In addition, it has become clear that people who are driving as part of their work are more likely than most to be involved in accidents where mobile phones are implicated.

The obvious conclusion is that if you are in business or if you need to drive for work, then the revised regulations are very important indeed.

As with any legislation, the precise meaning will only be known once it is "tested" in a court of law. Our recommendation, therefore, is to adopt a cautionary approach and do all that is reasonably practicable to ensure the safety of yourself and others.

Corporate Manslaughter

In legal circles there has been much frustration with the failure to successfully prosecute any of the companies involved with such major disasters as the Zeebrugge ferry or the rail disasters at Southall Potters Bar or Hatfield.

The general public also feel the frustration - being unable to understand why the law appears to be so impotent in the face of clear safety failures.

It now looks increasingly likely that a new Corporate Manslaughter Bill will be in force by July of this year to address these injustices, at least in part.

If you are not already aware of the changes in the Bill, you need to act now and ensure your organisation is adequately prepared.

Just a few days ago the media reported a case of Avian Flu (H5N1 strain) on a Suffolk Turkey farm. There was concern at the end of 2005 about the possibility of the virus reaching our shores and this news has served to raise those concerns again.

WEEE is Coming

Christmas is a time for rejoicing, celebrating, meeting with family and friends, parties and generally having a good time. However, it can also be a bit “messy” with plenty waste packaging, food, decorations and, of course, old items that need to be discarded because someone has bought us the latest models.

Not surprisingly, there is perhaps more emphasis this year on the environmental effect of our festivities – about the impact are we having on our planet.

This is the topic of our newsletter. If your business is involved with the production, distribution or sale of any type of electrical or electronic equipment, then you are affected and you need to have appropriate systems in place by July 2007.

Stress - The Problem is Growing

Stress is now accepted by the medical profession as a serious condition that can be a major factor in a variety of illnesses from migraine to eczema and even stroke. Stress is believed to weaken the immune system, leaving the sufferer vulnerable to all kinds of infection.

Employers have a legal duty toward their employees to ensure they do not face serious risks to their health in the course of their work, and that includes stress.

According to the Health and Safety Executive, prevention is better than cure and they encourage employers to assess the risks and discuss how to address them with their workforce.

Confined Space Working

You may be one of those people who cannot work in confined spaces, because you find the sense of claustrophobia overwhelming. On the other hand it may not trouble you at all.

Claustrophobia in confined spaces, however, is not the main concern of health and safety. It’s more to do with the hidden risks that lurk in places were there is a lack of adequate ventilation or where access and egress are difficult – things like reduced oxygen levels, build up of noxious gases, sudden and rapid flooding, build up of heat, presence of explosive gases and other things.

Part of the problem is that circumstances can change in unexpected ways between places that are superficially similar or in the same place over a period of time. It’s this ‘uncertainty’ aspect that is the subject of our latest newsletter.

Perhaps you think that confined space working doesn’t affect you but then you may be wrong. You see a confined space doesn’t have to be physically small. An enclosed place of any size – even for example as big as a grain silo – may be a confined space if certain risks are present.

As demonstrated by this month’s example under Case Law, it’s easy to become complacent but that can prove very expensive in the long run. It’s much better to get the right advice now.
